WEEE (ElektroG) in Germany – A practical guide for businesses

WEEE (ElektroG) in Germany – A practical guide for businesses
19.08.2025 Reading time: 3 min By EPR Team

The WEEE Directive (Waste of Electrical and Electronic Equipment), implemented in Germany through the ElektroG (Electrical and Electronic Equipment Act) Directive 2012/19/EU, is a key environmental regulation for companies selling electrical and electronic products in the German market. It defines rules for the marketing, collection, and recycling of all types of electrical and electronic equipment (EEE). The aim is to reduce the environmental impact of e-waste and ensure valuable resources are recovered and reused. ElektroG applies to a wide range of products – from household appliances and IT equipment to consumer electronics and lighting – all of which must be disposed of and recycled in an environmentally sound way.

Core requirements

ElektroG is based on the principle of extended producer responsibility, which makes manufacturers and distributors responsible for the full life cycle of their products, including their collection and recycling at end-of-life. Before placing products on the market, companies must register with the Stiftung Elektro-Altgeräte Register (EAR). All products must be labelled with the crossed-out wheeled bin symbol and must carry a valid registration number issued by EAR. In addition, companies must offer free take-back options for end-of-life devices, provide an insolvency-proof guarantee to ensure proper disposal even in case of business closure, and submit regular reports on quantities placed on the market and collected.

Key ElektroG obligations include:

  • Registration with Stiftung EAR before placing products on the market
  • Proper labelling of all electrical and electronic equipment
  • Accessible take-back systems for consumers
  • Insolvency-proof guarantee for waste management
  • Ongoing reporting on sales and collected quantities

Who needs to comply with WEEE (ElektroG)?

All companies that sell electrical and electronic equipment on the German market are subject to ElektroG requirements. This includes manufacturers, importers, and retailers – both online and offline – as well as foreign businesses that market their products to German consumers. Whether a company has a physical presence in Germany or not is irrelevant for compliance purposes.

What happens if companies don’t comply?

Failure to comply with ElektroG can result in severe penalties, including fines of up to 100,000 EUR, sales bans, and public naming by authorities. Non-compliant businesses can be prohibited from selling their products until they meet all legal obligations. Moreover, major online marketplaces such as Amazon and eBay now require proof of EAR registration to list relevant products, meaning non-compliance can also block access to key sales channels.
