Packaging obligations in Poland: How to fulfil your EPR obligations efficiently and with legal certainty

Poland has consistently transposed the EU requirements on extended producer responsibility (EPR) into national law – with far-reaching consequences for all companies that place packaged products on the Polish market. Whether manufacturer, retailer or online shop: without complete registration and reporting obligations, there is a risk of fines or even sales bans.

Circular Pro supports you in complying with all legal requirements – transparently, individually and from a single source.

Who is affected?

The EPR requirements apply to all companies that bring packaging into circulation in Poland – regardless of whether they are based in the country or trade across borders. This means that e-commerce retailers and manufacturers with sales to Poland are also included in the obligated group.

These are your central obligations

So that you can act with legal certainty in Poland, you must, among other things:

  • register in the central packaging and product register (BDO),
  • report packaging quantities and pay licence fees,
  • comply with environmental regulations and recycling quotas,
  • if necessary, appoint an authorised representative if you do not have your own branch in Poland.

Registration in the BDO is mandatory – before even a single product is dispatched.

A look ahead: the new deposit system from October 2025

Poland is planning to introduce a nationwide deposit system for single-use drinks packaging from 1 October 2025. This will affect:

  • PET bottles up to 3 litres,
  • Metal cans up to 1 litre,
  • Returnable glass bottles up to 1.5 litres.

Here too, manufacturers and importers must prepare for the new requirements in good time – including labelling, registration and participation in approved take-back systems. Exceptions apply to packaging for dairy products or small bottles.
