Any person who, regardless of the sales method,

a) is established in Austria and manufactures electrical or electronic equipment or has it designed and manufactured and sells it under their brand name, or

b) is established in Austria and resells equipment from other suppliers under their brand name, whereby the reseller is not considered a manufacturer if the brand name of the manufacturer according to a) is affixed to the equipment, or

c) is established in Austria and imports electrical or electronic equipment into Austria on a commercial basis as an importer (the parties to the purchase contract and the invoicing are decisive, not the delivery route) or exports it from Austria for delivery to end consumers, or

d) is established in another Member State of the European Union and distributes electrical or electronic equipment to resellers and has appointed an authorised representative as a ‘foreign manufacturer’ or

e) is not established in Austria and sells electrical or electronic equipment directly to end consumers in Austria as a ‘foreign distance seller’ with the aid of distance communication.

In principle, all equipment falls within the scope of the Directive, unless there is an exemption. Electrical and electronic equipment is equipment that requires electric current or electromagnetic fields for its proper operation, and equipment for the generation, transfer and measurement of such currents and fields, which is designed for operation with an alternating voltage of not more than 1000 volts or a direct voltage of not more than 1500 volts. Electronic spare parts or devices, electronic components and parts can also be classified as electrical equipment if they are placed on the market as individual devices. Some products fall within the scope if their proper operation or main and basic function is only possible with electrical energy. If it is only a ‘gimmick’, then a product often falls outside the scope – this must be assessed on a case-by-case basis.

Manufacturers within the meaning of the WEEE Directive who are based in Austria must submit a registration application on the EDM portal (Austrian register). This will

provide the manufacturer with their GLN number, which is the unique registration number in Austria. After receiving the access data from the Federal Environment Agency (UBA), it is important to log in and maintain the data. At your request, UFH can initiate the registration application for your company.

For manufacturers based outside Austria who appoint UFH as their authorised representative, UFH will take care of the registration with the responsible Austrian Federal Ministry (BMLUK).
